These Terms and Conditions, as may be amended from time to time, apply to all our services directly or indirectly made available online, through any mobile device and/or website. By using our land search services through our website, or any application (including mobile devices) made available by Ezlaw International Sdn Bhd, you acknowledge and agree to be bound by these terms of use ("Terms of Use").
For the purpose of these Terms of Use:
- "Service Provider", "EasyLaw", "we", "us", and "our" refer to Ezlaw International Sdn Bhd;
- "Customer", "you", and "your" refer to any person or entity who uses the land search service provided by the Service Provider.
1. GOVERNING LAW
1.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Malaysia.
1.2 The Service Provider's collection, use, and protection of Customer data is governed by our Privacy Policy. By using our services, Customers consent to such collection and use in accordance with the Personal Data Protection Act 2010.
1.3 These Terms and Conditions constitute the entire agreement between the Service Provider and Customer regarding land search services. In the event of any conflict with other agreements (including non-disclosure agreements or service agreements), these Terms shall prevail.
2. REFUND POLICY
2.1 Full Credit Refund may only be provided where the land search submission has not been processed by Ezlaw International Sdn Bhd. Service Provider retains the right at its discretion to determine if the land search is entitled to a full refund.
2.2 Partial Credit Refund is available only for Land Office Disbursement which is a sum of fee payable to the respective land office. For Penang (Official Land Search & CTC Title), the Service Provider will not refund land office disbursement into the client’s EasyLaw account if the land search is Tak Wujud / Batal as the Land Offices has a no-refund policy. For other states, we will refund land office disbursements into the customer’s account if the land search is Tak Wujud / Batal if customers have replied to our email within 7 days from the date of receiving the email from Ezlaw International Sdn Bhd notifying the status of the ‘ Tak Wujud’ or ‘Batal’ land search. No credit refund is provided if there is no reply within 7 days.
2.3 Malaysia Sales & Service Tax (SST) is strictly non-refundable in any form such as cash, EasyLaw credit etc as it has been remitted to the relevant authorities.
3. DUTIES AND RESPONSIBILITIES OF CUSTOMER
3.1 Customers shall be responsible for ensuring that the data provided in the land search form prior to submission of the land search is accurate.
3.2 The Service Provider shall not be liable for any invalid land searches when the land search is conducted based on the land search form submitted through the service provider's website or/and any application (including mobile).
3.3 The Service Provider shall not be liable to recheck the land search request with the wrong information submitted through the service provider's website or/and any application (including mobile). Service Provider will only partially refund the land office disbursement subject to Clause 2 above.
3.4 The Service Provider conducts the land search based on the data submitted through the land search form. Any other documents, attachments, or pictures provided by Customers are solely for the Customer's reference.
3.5 Customers acknowledge that land search data is provided for their internal use only. Customers assume all risk and liability for any redistribution, sharing, or incorporation of land search data into downstream products, services, or databases. Customers agree to indemnify the Service Provider from any third-party claims arising from Customer's use or distribution of land search data.
4. NON-CANCELLATION POLICY FOR LAND SEARCH REQUESTS
4.1 All land search requests initiated on the Ezlaw International Sdn Bhd's website, regardless of their current status, including but not limited to the status of "Processing", and "Tak wujud/Batal", are strictly non-cancellable. Under no circumstances will cancellations be permitted.
4.2 The Service Provider will unequivocally reject and will not process any and all requests for the cancellation of EasyLaw land search orders, irrespective of their timing or the reasons provided.
4.3 The Service Provider is not obligated to provide detailed progress updates or internal process documentation for land search requests. Customers will be notified of completion or material status changes (e.g., 'Tak Wujud/Batal').
5. EASYLAW DISPATCH CHARGES
5.1 EasyLaw Dispatch Charges are non-refundable and no credit refund if the land search has been processed by the Service Provider. Customers shall be responsible for ensuring that the data provided in the land search form prior to submission of the land search is accurate.
5.2 The Service Provider shall not be liable for any invalid land search result when the land search is conducted based on the information submitted by customers through the Ezlaw International Sdn Bhd website or/and any application (including mobile).
6. LAND OFFICE DISBURSEMENT
6.1 By submitting a land search request on Ezlaw International Sdn Bhd's website, customers have accepted and acknowledged the price of the land office disbursement, and this payment is made to the respective land office.
7. LIMITATION OF LIABILITY
7.1 The Service Provider's total aggregate liability for any claim arising from land search services shall not exceed the fees paid by the Customer for the specific land search(es) giving rise to the claim. This cap applies to all claims of any nature, including direct, indirect, consequential, third-party, or reimbursement claims. The Service Provider shall not be liable for any indirect, consequential, incidental, punitive, or special damages.
8. SMARTFILL AI FEATURE
8.1 SmartFill is a beta feature by Ezlaw International Sdn Bhd and is currently provided to all users for testing purposes. By using SmartFill, you agree to participate in the testing phase and acknowledge that some features might still be in the process of development and fine-tuning.
8.2 While SmartFill utilizes advanced technology for data extraction, Ezlaw International Sdn Bhd does not guarantee complete accuracy. Users are responsible for reviewing and verifying the populated form fields for any potential errors or inaccuracies before submitting the land search form.
8.3 Users acknowledge that they are solely responsible for the accuracy, legality, and relevance of the documents they upload. Ezlaw International Sdn Bhd shall not be liable for any consequences arising from the use of SmartFill and the information provided by users.
8.4 SmartFill supports JPEG and PNG formats only. Users are advised to ensure that their uploaded documents comply with the specified formats.
8.5 EzLaw International Sdn Bhd prioritizes data privacy and security. However, given the nature of data transmission over the internet, users are advised to exercise caution when uploading sensitive information.
8.6 SmartFill's availability is subject to change without prior notice. Ezlaw International Sdn Bhd reserves the right to modify or discontinue the feature, either temporarily or permanently, at its discretion.
8.7 We value user feedback to improve SmartFill. By using the feature, you agree to provide feedback and suggestions, which may be used by Ezlaw International Sdn Bhd for further development and enhancements.
8.8 All intellectual property rights related to SmartFill, including its design, code, and content, belong to Ezlaw International Sdn Bhd. Users are prohibited from copying, modifying, or reproducing any part of the feature without explicit permission.
8.9 Users shall indemnify and hold EasyLaw and its affiliates harmless from any claims, losses, damages, or liabilities arising from their use of SmartFill or any violation of these Terms and Conditions.
9. DISCLAIMER
9.1 By using EasyLaw Land Search service, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, refrain from using the EasyLaw Land Search service. Ezlaw International Sdn Bhd reserves the right to update or modify these Terms and Conditions as needed, and continued use of EasyLaw Land Search service will indicate acceptance of any such changes.
